Terms of Use for Web Hosting Service with Clarmedia
Use of Clarmedia hosting services constitutes the acceptance of our Policies.
All Web Hosting accounts are designed to be used by one individual or corporate
entity. Customers may not resell space located under the customer's domain without
the explicit consent of Clarmedia. Violation of this will result in termination
of the account without a refund.
Payment for Web Hosting services is due on the 1st of every month. Service
will be interrupted on accounts that reach 15 days past due. Checks returned
for any reason are subject to a $20.00 fee. Service interrupted for nonpayment
is subject to a $10.00 reconnect fee.
All Web Hosting accounts have a 15-day money back guarantee. If you are not

Your Web Hosting account will be closed and a refund will
be issued. Refunds are not available after the first 15 days of service. Refunds
are not applicable to special promotions. If cancelled after 15 days there will
be a $15 contract termination charge.

You can cancel your Web Hosting account
at any time, however, please bear in mind that we require 30 days notice in
order to complete your current billing cycle. If a notice of less than 30 days
is provided, you will not be refunded for the remainder of the month regardless
of usage. The remaining amount owed will be refunded minus the contract termination
charge will be deducted from the refund.
All domain name registrations are due and payable upon registration. No refunds
will be available on domain names under any circumstances once such domain is
registered as per ICANN rules (Internet Corporation for Assigned Names and Numbers.)
Clarmedia cannot guarantee any name will be available at the time of registration.
Customer agrees to hold Clarmedia free and harmless from any liability or litigation
that can arise from any domain name reservation.
New Web Hosting accounts involving new domain name registrations will be set
up and entered into our DNS servers within 12 hours, however, due to the nature
of Domain Name Servers, your domain might not be accessible for a period of
up to 7 days.
Due to the nature of the service provided, an interruption could occur for
many reasons beyond Clarmedia's negligence. Damages resulting from any interruption
of service are too difficult to ascertain. Clarmedia shall not be liable for
any damages that arise from such causes. Clarmedias liability for its own negligence
may not in any event exceed an amount equivalent to charges payable for your
specific hosting plan during the period damages occurred.
Clarmedia makes full backups every week, and backups of new and changed data
every night. No guarantees are made of any kind, either expressed or implied
as to the integrity of these backups. Backups are made for server restoration
purposes only. It is your responsibility to maintain local copies of your web
content. If for any reason a loss of data occurs, we will attempt to do our
best to recover such data. We reserve the right to delete user's files after
one or both parties terminates agreement.
Clarmedia will not sell or disclose your information with anyone without your
explicit consent. Clarmedia cooperates with those attempting to minimize Internet
abuse, and reserves the right to institute mechanisms as part of its efforts
to reduce such abuse. Clarmedia will not monitor or disclose your email messages
unless required to do so by court order or law, however, Clarmedia will cooperate
with law enforcement authorities and will notify such authorities if it suspects
illegal activities.
You are entitled to receive "Free Technical Support", however, technical
support is only available via email or Web forms and is limited to issues directly
related to Web Hosting such as server connectivity, http, ftp and email services.
Clarmedia does provide technical support for configuring, using and/or troubleshooting
third party applications including but not limited to: Mailman Mailing Lists,
MySQL Databases, Akopia Shopping Carts and CGI Scripts this will be billed at
a rate of $50 US (fifty dollars). Clarmedia will only provide support via telephone
if you need assistance with issues related to your service being operational,
in which case you can call our main number at (888) 505-CLAR. If you can email,
and you have any other type of problem, we encourage you to email

CUSTOMER AGREES TO HOLD CLARMEDIA HARMLESS FROM ANY AND ALL DEMANDS, LIABILITIES,
LOSSES, COSTS AND CLAIMS, INCLUDING REASONABLE ATTORNEY'S FEES ASSERTED AGAINST
CLARMEDIA, ITS AGENTS, ITS CUSTOMERS, OFFICERS AND EMPLOYEES, THAT MAY ARISE
OR RESULT FROM ANY SERVICE PROVIDED OR PERFORMED OR AGREED TO BE PERFORMED OR
ANY PRODUCT SOLD BY CUSTOMER, IT'S AGENTS, EMPLOYEES OR ASSIGNS. CUSTOMER AGREES
TO HOLD HARMLESS CLARMEDIA AGAINST LIABILITIES ARISING OUT OF; (1) ANY INJURY
TO PERSON OR PROPERTY CAUSED BY ANY PRODUCTS SOLD OR OTHERWISE DISTRIBUTED IN
CONNECTION WITH CLARMEDIA SERVERS; (2) ANY MATERIAL SUPPLIED BY CUSTOMER INFRINGING
OR ALLEGEDLY INFRINGING ON THE PROPRIETARY RIGHTS OF A THIRD PARTY; (3) COPYRIGHT
INFRINGEMENT AND (4) ANY DEFECTIVE PRODUCTS SOLD TO CUSTOMER FROM CLARMEDIA
SERVERS.
Clarmedia reserves the right to cancel any member for violating any of these
Terms and Conditions without any refund of service.
